What changed, in plain language

Photobucket rebranded its service as "Groupsy" and rewrote the Terms of Use around Groups and a personal Library. Account names changed (Free Tier → Free Plan, Paid → Plus Plan), and the company added a promise it will never use your photos or videos to train AI. But several protections were quietly trimmed: cancelling now only lists email as an option, plan features and prices can be changed with notice on a separate web page and your continued use counts as agreement, Legacy Free Accounts can now be deleted "without notice," and free accounts get their older photos blurred once you pass the item limit. Some EU/UK and California privacy call-outs were also deleted from the text.

Your continued use of the Services following any such change constitutes your acceptance of the updated Plan Specifications.

What you can do — Bookmark photobucket.com/legal/account-types and check it every few months, especially before your renewal date, so a price or storage change doesn't catch you by surprise.

TERMINATION

If you hold a Legacy Free Account, Photobucket can now delete your account and all your photos "without notice." The old version didn't include those words, and it also told you that you could download your content from the account deletion page — that option was removed, leaving only emailing support before deletion happens. If deletion comes without notice, there may be no chance to ask.

If you do not convert your Legacy Free Account to a Plus Plan Account, we may, in our sole discretion and without notice, delete your Account and/or your Content.

The old terms promised you could cancel by email or by any other cancellation method the service offered. The new text lists only the support email address. This may mean there's no self-service cancel button you can rely on, so cancelling could depend on someone answering your email before your renewal date. If you go over the free item limit, your older photos are blurred out — still stored, but you can't see them properly — until you pay for the Plus Plan. And once a Group hits its limit, nobody in that Group can upload anything until the owner upgrades. Your photos aren't deleted, but access to your own older uploads is now tied to paying.

We are not responsible for any shared Private User Uploaded Content that has been shared after being marked as "private" according to the past Services offered by Photobucket, except to the extent that such exposure was caused by our failure to implement reasonable security measures.

The Arbitrator shall also be responsible for determining all threshold arbitrability issues, including issues relating to whether these Terms of Use are illusory and any defense to arbitration, including waiver, delay, laches, or estoppel. Notwithstanding any choice of law or other provision in these Terms of Use, the parties agree and acknowledge that this Arbitration Agreement evidences a transaction involving interstate commerce and that the Federal Arbitration Act, 9 U.S.C. § 1 et seq.
