Privacy Policy

DATED 2026-08-11 · VERSION 20260812_rev01 · FIRST CAPTURED VERSION

What changed, in plain language

Photobucket's privacy policy was rewritten for its rebranded "Groupsy" app, replacing the old Private/Public/Shareable album system with a personal Library and invite-only Groups. Most content-license changes favor users — the old "perpetual, irrevocable, transferable" license over private uploads is gone, and the company now promises in writing it will never sell your content or use your photos to train AI. But the update also quietly adds three new ways your information can reach outside companies: vendors that tag your photos, WhatsApp/Meta integrations, and sharing your email with affiliates and social platforms. It also deletes the list of specific purposes cookies are used for, and puts the FaceFinder face-search feature behind the paid Plus Plan.

Changes that may affect you

Outside companies can now handle your photos for taggingMATERIAL
DATA SHARING

A new sentence lets Photobucket hire other companies to tag your images or process the data attached to them. Your photos were previously described as only being stored and served back to you. The policy limits this to running and improving the service and says it is not for identifying people, but your pictures can now pass through vendors you have no relationship with.

We may engage service providers to perform limited image tagging or metadata processing on Content solely to provide and improve the Services.

What you can do — If you don't want vendors handling your photos, ask what tagging services are used by emailing support@photobucket.com, and consider deleting content you don't want processed.

Your email address can be sent to affiliates and social media platformsMATERIAL
DATA SHARING

Photobucket added a new reason to share your email with outside partners: to keep it off marketing lists run by affiliates and social platforms on its behalf. Even though the purpose is to reduce ads you see, it means your email address is being uploaded to advertising and social media companies.

to suppress your email address from affiliate and social platform marketing efforts on our behalf

What you can do — Ask to be removed from Photobucket's mailing lists by emailing support@photobucket.com.

WhatsApp and Meta connections addedMATERIAL
DATA SHARING

The policy now names WhatsApp and Meta as services the app can link to. When you use those links, information can flow to Meta, and Photobucket says plainly that it does not control what those companies do with it and that its privacy policy does not cover them.

The Services may include functionality that allows certain kinds of interactions between the Services and your account on a Third Party Service, including WhatsApp and Meta integrations.

What you can do — Avoid connecting your Groupsy account to WhatsApp or Meta if you don't want data flowing to them, and read Meta's privacy policy before you do.

The list of what cookies are used for was deletedMINOR
DATA COLLECTION

The old policy said cookies were used for four specific things and disclosed that a third party sometimes ran re-marketing (ad retargeting). Those details are gone. Cookie use is no longer tied to a stated list, so there's less to hold the company to and less transparency about ad tracking.

**Cookies.** A cookie is a file placed on a device to uniquely identify your browser or to store information on your device.

What you can do — Use the cookie settings on the site to reject non-essential cookies, and clear cookies in your browser.

Removed the statement that a photo of a face is biometric informationMINOR
OTHER

The definition used to say clearly that a photograph of someone's face counts as biometric information, not just a faceprint made from it. That example was cut in the same update that added third-party photo tagging, which makes it less clear how your face photos are treated when vendors process them. The broader definition it illustrated is still there.

"Biometric Information" refers to data that depict or describe physical, biological, or behavioral traits, characteristics, or measurements of or relating to an identified or identifiable person's body.

What you can do — Read the linked Biometric Information Privacy Policy, which the company says still governs how face data is handled.

Rules for older uploads became vaguerMINOR
CONTENT LICENSE

The old policy promised that content uploaded before the effective date stayed under the license terms from when you uploaded it. Now it only says such content "may be subject to" those terms. The section explaining that pre-2024 public albums stay public for Legacy Free Accounts was also dropped, so long-time users have less clarity about who can see and use their older photos.

User Uploaded Content stored in legacy accounts prior to the Effective Date of these policies may be subject to the license terms in effect at the time of upload.

What you can do — If you have photos from before 2024, email support@photobucket.com to ask in writing which license terms and privacy setting apply to them.

FaceFinder is now paid-only and limited to GroupsMINOR
OTHER

The on-device face-search feature now requires a Plus Plan subscription and only searches photos inside your Groups — your personal Library is excluded. If you used it on a free plan or for your own library, you would need to pay or lose access to that function.

Photobucket offers an optional on-device FaceFinder Feature, available exclusively to Plus Plan subscribers

What you can do — If you rely on FaceFinder, check whether your current plan is a Plus Plan before your photos are reorganized into Groups.

Changelog

  1. ± CHANGEDApp rebranded to "Groupsy"; printing and hosting dropped from service list

The app is now called Groupsy instead of Photobucket, and the described services swap "printing" and "hosting" for "group collaboration." The company is still Photobucket.com, Inc.

Photobucket application ("App") or other services, such as photo and video sharing, storage, printing, hosting and digitization services provided by Photobucket.com to you

Groupsy application ("App"), and other services provided by Photobucket.com to you, such as photo and video sharing, storage, group collaboration, and digitization services

  2. + ADDEDOutside vendors may now tag and process your photos

A brand-new paragraph says Photobucket can hire other companies to do "image tagging or metadata processing" on your content. The policy says this is not for identifying people, but it does mean your photos and the data attached to them can now be handled by third parties.

We may engage service providers to perform limited image tagging or metadata processing on Content solely to provide and improve the Services. This processing is not performed for the purpose of identifying individuals, and these service providers do not receive or generate Biometric Information for identification purposes.

  3. ± CHANGEDWhatsApp and Meta integrations named as connected services

The third-party section now specifically calls out WhatsApp and Meta as services the app can connect to. Using those connections can send your information to those companies, and Photobucket says it does not control what they do with it.

The Services may include functionality that allows certain kinds of interactions between the Services and your account on a Third Party Service.

The Services may include functionality that allows certain kinds of interactions between the Services and your account on a Third Party Service, including WhatsApp and Meta integrations.

  4. ± CHANGEDYour email address can be shared with affiliates and social platforms

Photobucket added a new reason it may hand your email address to outside partners: to "suppress" it from marketing run for them by affiliates and social media platforms. The stated goal is to stop you seeing certain ads, but it still means your email goes to those ad platforms.

we may make information available to specific business partners, sponsors, or service providers for the purpose of providing you the Services and complying with applicable laws

to suppress your email address from affiliate and social platform marketing efforts on our behalf

  5. ± CHANGEDThe old perpetual, irrevocable license over private uploads is gone

Under the old policy, content you marked "Private" was covered by a license that never expired and could be handed to someone else. The new Library license is narrower: it only exists to run the service for you, and it ends when you delete the content (apart from backups and legally required copies).

you granted us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, transferable right and license to: copy, stream, post, display, publicly perform, and reproduce the Private User Uploaded Content

When you upload Content to your Library, you grant us a worldwide, non-exclusive, royalty-free license to copy, stream, post, display, and reproduce your Library Content solely to offer the Services to you. This license terminates upon your valid deletion of the applicable Library Content, subject to backup and legal retention obligations.

  6. ± CHANGEDPrivate/Public/Shareable albums replaced by Library and Groups

The whole album system is redescribed. Content now goes either to your private personal Library or to a Group, which the policy calls a private, invite-only space. The old license for "Public" content, which included the right to distribute it and make derivative works, is gone.

You grant us a worldwide, non-exclusive, royalty-free license to: copy, convey, distribute, stream, post, publicly display (e.g., post it elsewhere), reproduce Public User Uploaded Content, and create derivative works solely as necessary to provide, display, and optimize the Services

**Group Content.** "Group Content" refers to User Uploaded Content uploaded to a Group. Groups are private, invite-only spaces. When you upload Content to a Group, you grant us a worldwide, non-exclusive, royalty-free license to copy, stream, post, display, publicly perform, and reproduce your Group Content solely to offer our Services to you and Group Members.

  7. + ADDEDNew promise: no selling your content and no AI training

Photobucket added an explicit commitment not to sell, lease, trade, license or profit from your uploads or biometric data, and never to use your photos or videos to train AI.

Photobucket does not sell, lease, trade, license, or otherwise profit from User Uploaded Content or Biometric Information. We will never use your photos or videos to train artificial intelligence.

  8. ± CHANGEDRules for older uploads are now vaguer

The old policy stated flatly that content uploaded before the effective date kept the license terms from when it was uploaded. The new version says such content "may be subject to" those terms. The explanation that pre-2024 public albums stay public for Legacy Free Accounts was deleted entirely.

For User Uploaded Content uploaded prior to the Effective Date of this Privacy Policy, the license terms in effect at the time of upload continue to govern.

User Uploaded Content stored in legacy accounts prior to the Effective Date of these policies may be subject to the license terms in effect at the time of upload.

  9. ± CHANGEDFaceFinder is now a paid feature, limited to Groups

The on-device face-search tool is now only for Plus Plan subscribers, and it only searches photos in your Groups — not your personal Library. The policy also adds a clearer way to withdraw consent by deleting a face with the pencil icon.

Photobucket offers an optional on-device FaceFinder Feature.

Photobucket offers an optional on-device FaceFinder Feature, available exclusively to Plus Plan subscribers, that allows you to identify and organize photos within your Groups by the faces appearing in them, using on-device processing that you initiate and control.

  10. − REMOVEDDeleted the list of what cookies are used for

The old policy listed the four specific things cookies were used for and mentioned that a third party sometimes provided re-marketing (ad retargeting) services. All of that is gone, so cookie use is no longer tied to a stated list of purposes.

We use cookies in the following ways: (a) to track how you use our Services; (b) to record whether you have seen specific messages we display on our Services; (c) to keep you signed in to our Services; and (d) to record your answers to surveys and questionnaires on our Services while you complete them. We may use a third party to provide us with re-marketing services from time to time.

  11. − REMOVEDExample of what counts as biometric information removed

The definition used to spell out that a photo of someone's face, as well as a faceprint made from it, both count as biometric information. That example was cut, though the broader definition it illustrated remains.

By way of example, both a photograph of a person's face and a facial recognition template, embedding, faceprint, or other data that encode measurements or characteristics of the face depicted in the photograph constitute Biometric Information.

  12. ± CHANGEDStronger wording on biometric data and company sales

"License" was added to the list of things Photobucket promises not to do with biometric information, and any company that buys Photobucket must now follow the Biometric Information Privacy Policy too, not just this privacy policy.

Photobucket does not sell, lease, trade, or otherwise profit from Biometric Information.

provided that the receiving entity will comply with this Privacy Policy and the Biometric Information Privacy Policy

  13. − REMOVEDWarnings and disclaimers about shared content removed

Several passages disappeared: the caution that content marked "Private" or shared by link could still be seen by others, and the matching statements that Photobucket took no responsibility for what third parties do with content that becomes public. You lose the warning, but Photobucket also drops those particular disclaimers.

Once your information enters the public domain, we have no control over what any individual third party may do with it. We accept no responsibility for their actions at any time.

  14. ± CHANGEDAccount tiers renamed

"Free Tier Account" is now "Free Plan Account" and "Paid Account" is now "Plus Plan Account." Legacy Free Accounts keep their name.

Free Tier Account, Legacy Free Account, and Paid Account

Free Plan Account, Legacy Free Account, and Plus Plan Account

  15. ± CHANGEDFormatting, terminology, and housekeeping edits

Section headings were converted to markdown, "Device" was lowercased throughout, "album" became "Group" and "Group Album Invitees" became "Group Members," retention factors were turned into bullets, and minor lines were trimmed (a note about statutory storage of contracts and business letters, advice to close your browser, and advice to print a copy of the policy). The effective date moved to August 11, 2026.

    Effective Date: April 13, 2026

28### Biometric Information
2929
30**Definition.** "Biometric Information" refers to data that depict or describe physical, biological, or behavioral traits, characteristics, or measurements of or relating to an identified or identifiable person's body. Biometric Information includes, but is not limited to, depictions, images, descriptions, or recordings of an individual's facial features, iris or retina, finger or handprints, voice, genetics, or characteristic movements or gestures (e.g., gait or typing pattern). Biometric Information also includes data derived from such depictions, images, descriptions, or recordings, to the extent that it would be reasonably possible to identify the person from whose information the data had been derived. By way of example, both a photograph of a person's face and a facial recognition template, embedding, faceprint, or other data that encode measurements or characteristics of the face depicted in the photograph constitute Biometric Information. There are different definitions for biometric information, or biometric data, under different state laws. This definition is based on the Federal Trade Commission's Policy Statement on Biometric Information and is broader than certain legal definitions. Where applicable law defines biometric data more narrowly, those legal definitions control for purposes of compliance with that law.

90User Uploaded Content
90### User Uploaded Content
9191
92**Definition.** Our Services allow you to upload the most commonly-used image and video files. These image files and video files, both in their native uploaded form and any subsequently edited version stored with the Services, are referred to individually and collectively as "User Uploaded Content." User Uploaded Content may be Private User Uploaded Content (defined below), Public User Uploaded Content (defined below), or Sharable User Uploaded Content (defined below). When uploading Content or other Personal Information, it is up to you to satisfy yourself about the privacy level of every person who might use it. Once your information enters the public domain, we have no control over what any individual third party may do with it. We accept no responsibility for their actions at any time. Please note that User Uploaded Content, in addition to being subject to this Privacy Policy, is also governed by our [Terms of Use](https://photobucket.com/legal/terms-of-service) and our [Biometric Information Privacy Policy](https://photobucket.com/legal/biometric-information-privacy-policy).
92**Definition.** Our Services allow you to upload the most commonly-used image and video files to your personal Library or to a Group. These image files and video files, both in their native uploaded form and any subsequently edited version stored with the Services, are referred to individually and collectively as "User Uploaded Content." When uploading Content or other Personal Information, it is up to you to satisfy yourself about the privacy level of every person who might use it.
9393
94**Private User Uploaded Content.** In the past versions of Services offered by Photobucket, a Subscriber with an Account could mark any album with User Uploaded Content they uploaded as "Private" ("Private User Uploaded Content"). Although we created measures to protect your privacy, please be aware that just because something is marked "Private" does not mean that only the people you invite will see it in all instances. For example, individuals may still be able to find the direct URL for a photo or through other search mechanisms, and then share or link to it outside the Services. If you share Private User Uploaded Content from the Services or provide someone with a direct link to Private User Uploaded Content, others may be able to see it, even if you marked it "Private" according to the past versions of the Services. We are not responsible for any shared Private User Uploaded Content that has been shared after being marked as "Private."
94**Library Content.** "Library Content" refers to User Uploaded Content stored in your personal Library, which is your private personal photo and video storage.
9595
96For User Uploaded Content uploaded prior to the Effective Date of this Privacy Policy, the license terms in effect at the time of upload continue to govern. For User Uploaded Content uploaded on or after the Effective Date, the license terms set forth in the current Terms of Use apply.
96**Group Content.** "Group Content" refers to User Uploaded Content uploaded to a Group. Groups are private, invite-only spaces. When you upload Content to a Group, you grant us a worldwide, non-exclusive, royalty-free license to copy, stream, post, display, publicly perform, and reproduce your Group Content solely to offer our Services to you and Group Members. This license terminates upon your valid deletion of the applicable Group Content, subject to backup and legal retention obligations. Any prior sharing of such content with Group Members may continue to be accessible to recipients notwithstanding deletion.
9797
98**Private User Uploaded Content Use.** When you uploaded Content you marked as "Private," you granted us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, transferable right and license to: copy, stream, post, display, publicly perform, and reproduce the Private User Uploaded Content so that we may offer the Services to you and to others at your request (e.g., image sharing and hosting by you) as well as other rights set forth herein.
98**Legacy Content.** User Uploaded Content stored in legacy accounts prior to the Effective Date of these policies may be subject to the license terms in effect at the time of upload. For User Uploaded Content uploaded on or after the Effective Date, the license terms set forth in the current Terms of Use apply. If you have questions about the status of legacy content, please contact us at [support@photobucket.com](mailto:support@photobucket.com).
9999
100**Public User Uploaded Content.** The past versions of Services offered by Photobucket allowed you to upload and share images and information that, by doing so and marking such albums "Public," you intended others to interact with, including by: (a) tagging, describing, or commenting on images, whether hosted by you or someone else; (b) making comments on a forum; or (c) clicking an icon next to another user's image or comment to convey agreement, disagreement, or thanks. This content is referred to as "Public User Uploaded Content." The concept of "Public" from the past versions of Services offered by Photobucket no longer exists for new uploads of User Uploaded Content as of February 6, 2024. User Uploaded Content or albums in the current version of the Services that were Public User Uploaded Content prior to February 6, 2024, remains Public for Legacy Free Accounts. User Uploaded Content uploaded as of February 6, 2024, is not Public User Uploaded Content.
100Photobucket does not sell, lease, trade, license, or otherwise profit from User Uploaded Content or Biometric Information. We will never use your photos or videos to train artificial intelligence.
101101
102**Public User Uploaded Content Use.** We will store your Public User Uploaded Content and will use it for the purpose of providing our Services to you and, where applicable, to other users or recipients as directed by you or enabled by the Services. You grant us a worldwide, non-exclusive, royalty-free license to: copy, convey, distribute, stream, post, publicly display (e.g., post it elsewhere), reproduce Public User Uploaded Content, and create derivative works solely as necessary to provide, display, and optimize the Services, whether in print or any kind of electronic version that exists now or is later developed. The law in areas such as data privacy is continually changing. If you notice something amiss, please contact us at [support@photobucket.com](mailto:support@photobucket.com), and we will review and remedy the issue as appropriate. This license extends to backup copies and legally required retention for so long as such copies or retention obligations exist, and shall otherwise terminate upon your valid deletion of the applicable User Uploaded Content, subject to the foregoing exceptions. Any prior sharing of such content by you or at your direction may continue to be accessible to recipients notwithstanding deletion.
103
104**Sharable User Uploaded Content.** Albums and User Uploaded Content in the current version of the Services that were uploaded from a Paid Account are not Public User Uploaded Content because they are shareable instead of Public ("Sharable User Uploaded Content"). Public User Uploaded Content prior to February 6, 2024, for Paid Accounts was converted to Shareable User Uploaded Content as of February 6, 2024, because in the current version of the Services, albums with User Uploaded Content can be shared by creating a link. This link can be viewed by those with access to it and can also be password protected. These links are referred to as "Sharing Links." Although we created measures to protect your privacy, please be aware that just because something is accessible through a Sharing Link does not mean that only the people you invite will see it in all instances. We are also not responsible for any shared User Uploaded Content that has been shared with a Sharing Link under the current version of the Services.
105
106**Sharable User Uploaded Content Use.** When you upload Content to the versions of our Services introduced on February 6, 2024 or later, you grant us a worldwide, non-exclusive, royalty-free license to: copy, stream, post, display, publicly perform, and reproduce the Sharable User Uploaded Content solely to offer the Services to you and to others at your request (e.g., image sharing and hosting by you).
