What changed, in plain language

GoFundMe's privacy notice adds one substantive paragraph: people in the EU now give advance consent for GoFundMe to hand over their account information — including the actual content of their messages — to EU police and courts when served with a valid European Production Order. The rest of the update is a date change and a refreshed link to the prior version.

By using GoFundMe from the EU, you are counted as having already said yes to GoFundMe handing your account details and the content of your messages to EU police and courts. A U.S. law normally makes it harder for a company to give away message content to foreign authorities; your consent removes that speed bump, so a handover can happen faster and with fewer outside checks. There is no opt-out offered, and you are not promised notice when it happens. The impact is limited by the fact that it only applies to formal, valid EU legal orders, does not cover non-EU governments, and GoFundMe says it will review each request and can object, narrow, or refuse it.

This specific consent is granted solely to satisfy the requirements of the U.S. Stored Communications Act (18 U.S.C. § 2702(b)(3)) and facilitate compliance with EU law. This consent does not apply to requests from authorities outside of the EU.

What you can do — If you are in the EU, treat GoFundMe messages as potentially readable by authorities — keep sensitive personal details out of in-platform chats and use the privacy rights section of the notice to request a copy of your data or ask GoFundMe's Data Protection Officer whether your account has been subject to such an order.
